Terms and Conditions for GeoCam

These Terms and Conditions ("Terms") apply to your use of the GeoCam mobile app ("the app", "we", "us"). By downloading, installing or using the app, you agree to these Terms.

If you do not agree to these Terms, please do not use the app.

Our Privacy Policy explains how the app handles your information and is part of these Terms.

1. What the App Does

GeoCam lets you record videos and take photos with the date, time, GPS coordinates and, optionally, a street address printed onto them.

Your recordings are saved on your device. The app is free to use and is supported by ads.

2. Who Can Use the App

You must be at least 13 years old, or the minimum age required in your country, to use the app.

If you are under the age of majority where you live, you may use the app only with the permission of a parent or guardian.

3. Your Licence to Use the App

We give you a personal, non-exclusive, non-transferable and revocable licence to install and use the app on Android devices you own or control, for your own lawful use.

You must not:

Copy, modify, reverse-engineer, decompile or try to extract the app's source code, except where the law allows it.
Remove, hide or change any notices, attributions or ads in the app.
Resell, rent, sublicense or redistribute the app.
Use the app, or anything you make with it, to break any law or infringe anyone's rights.

4. Using the App Responsibly

You are solely responsible for what you record and how you use it. In particular:

Respect other people's privacy. Follow all laws on recording people, audio and places, including any rules about getting consent. Do not record in places where recording is not allowed.
Do not misuse the app. Do not use it to harass, stalk or monitor anyone without their permission, or for any fraudulent or illegal purpose.
Be careful when sharing. The location and time printed on a recording can be seen by anyone you share it with.

5. Accuracy of the Date, Time and Location

The app prints the information it gets from your device and from third-party services, and we do our best to make it accurate. However:

GPS location: Location depends on your device, signal strength and surroundings, and may be imprecise or out of date.
Street addresses: Street addresses come from OpenStreetMap, which is maintained by volunteers. Addresses may be incomplete, approximate or wrong, especially in areas that are poorly mapped. An address may also appear a few seconds after the coordinates, or be missing if you have no internet connection.
Date and time: Date and time come from your device's clock.

The app checks whether your device is using a fake (mock) location or a manually set clock and blocks recording if it finds either. These checks make the information on your recordings harder to fake, but they are not foolproof.

Important: We do not guarantee that the information printed on your recordings is accurate, complete or tamper-proof, or that it will be accepted as proof or evidence by any person, employer, insurer, court or authority. You are responsible for checking whether GeoCam recordings meet your needs before relying on them.

6. Your Content

You own the photos and videos you create with the app. We do not claim any rights to them and we never receive copies.
Your recordings are stored only on your device. We cannot back up or recover them. If you delete the app's recordings, lose or reset your device, or the files are otherwise lost, they cannot be restored by us.

Tip: Please keep your own backups of any important photos or videos created with GeoCam.

7. Ads

The app shows ads provided by Google AdMob, including banner ads and occasional full-screen ads.

We are not responsible for the content of ads or for any products, services or websites they link to. Any dealings you have with advertisers are between you and them.

8. Third-Party Services

The app relies on third-party services, including Google AdMob, Google Firebase and OpenStreetMap Nominatim .

Your use of these services through the app is also subject to their own terms and privacy policies. We do not control these services and are not responsible if they are unavailable, change or stop working.

9. Updates and Availability

We may update, change or remove features of the app at any time, without notice.
From time to time, we may require you to update to a newer version before you can keep using the app, for example to fix a serious problem. If your version is no longer supported, the app will ask you to update.
We do not promise that the app will always be available, error-free or compatible with every device, or that we will keep supporting it. We may stop offering the app at any time.

10. Intellectual Property

The app, including its design, code, name, logo and content (other than your recordings and third-party material), belongs to Ritesh Kumar Tiwari and is protected by applicable intellectual property laws.

These Terms do not give you any rights to our name, logos or trademarks.

11. Disclaimer of Warranties

The app is provided "as is" and "as available" , without warranties of any kind, express or implied.

This includes, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not guarantee that the app will meet your needs, work without interruption or errors, or keep your data safe from loss.

Some countries do not allow certain warranties to be excluded. In those places, the exclusions above apply only as far as the law allows.

12. Limitation of Liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, recordings, profits, business or reputation, arising from or related to:

Your use of, or inability to use, the app.
Inaccurate, missing or delayed date, time, location or address information.
Recording being blocked by the app's integrity checks.
Lost or deleted recordings.
Ads or third-party services.

Because the app is free, where the law does not allow us to exclude liability, our total liability to you for any claim is limited to the amount you paid us for the app, if any.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot legally be excluded.

13. Indemnity

You agree to protect and compensate Ritesh Kumar Tiwari against any claims, losses or costs (including reasonable legal fees) that arise from your misuse of the app, the recordings you make or share, or your breaking these Terms or any law.

14. Ending Your Use of the App

You can stop using the app at any time by uninstalling it. We may end or suspend your licence to use the app if you break these Terms.

Sections 5, 6, 11, 12, 13 and 16 continue to apply after your use of the app ends.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the Effective date at the top of this page.

If the changes are significant, we may also notify you in the app. If you keep using the app after the changes take effect, you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of INDIA . Any disputes will be handled by the courts of MADHUBANI, BIHAR, INDIA , unless the law where you live gives you the right to bring a claim somewhere else.

17. General

If any part of these Terms is found to be unenforceable, the rest will remain in effect.
If we do not enforce any part of these Terms right away, we do not give up our right to enforce it later.
These Terms and the Privacy Policy are the whole agreement between you and us about the app.
